# Worker housing violations in Saudi Arabia: fines, Qiwa suspensions and how to fix them

URL: https://sknliving.com/en/resources/worker-housing-violations-saudi/

**Short answer:** the biggest consequence of a worker housing violation isn't the fine. It's that **Qiwa services stop**, including visa-quota expansion and worker transfers. It can go as far as **suspending the commercial registration** of an establishment without licensed housing for its workers. Fines vary with the type of violation, repetition and the size of the company. The fix is licensed housing that matches your Qiwa headcount.

## Who can be in breach?

- **The establishment** with 20 or more workers that doesn't have licensed housing covering its Qiwa headcount.
- **The licence holder** (the owner, or the lessee of the whole building) if the housing doesn't meet the requirements.

It covers the establishment and all its branches, and paying workers a housing allowance doesn't exempt you from the licence.

## What actually happens to a non-compliant company

1. **The Balady–Qiwa link flags the gap.** Nobody has to report you: the system compares your headcount with the licensed housing registered to you.
2. **Qiwa services stop,** including visa-quota expansion and worker transfers.
3. **The commercial registration can be suspended** where there's no valid group housing licence, according to MOMAH's own page.
4. **Field inspection tours** check for the licence and for compliance with the rules.

So the fine is usually the smallest part of the problem. Frozen visas and transfers stop hiring and stall projects.

## Fines by type of violation

These bands are as reported in press coverage of the penalty schedule (Slaati, April 2025). The updated schedule may change the amounts, so check the latest version on Balady.

| Violation | Fine (SAR) |
|---|---|
| Using the licence for another purpose (e.g. families and individuals together), too little bedroom area per person, too few bathrooms, or exceeding licensed capacity | 1,000 to 5,000 |
| No equipped isolation room, power source, drinking water, catering or central kitchen, or kitchens not properly equipped | 600 to 3,000 |
| Installing certain barriers | 400 to 2,000 |

The updated penalty schedule grades fines by:

- the type of violation;
- repetition;
- the city's economic tier;
- the establishment's size under Monsha'at's classification.

In some cases a warning comes before the fine.

## The most common violations

- **Housing that was never licensed,** or a licence that expired without renewal.
- **More workers than the licensed capacity.** The licence is valid, but headcount grew.
- **Overcrowded rooms:** under 4 m² per person, or more than 10 in a room.
- **Too few bathrooms:** fewer than one sanitary set per 8.
- **Cooking or washing machines in rooms,** or people housed on roofs, in corridors or in basements.
- **A missing proof certificate:** the workers live in a licensed building, but the company never issued its certificate, so Qiwa shows a shortfall.

## How to put it right

Depending on your situation:

| Your situation | The fix |
|---|---|
| Workers are in unlicensed housing | Move them to licensed housing, or license the building if you own or lease all of it |
| In a licensed building without a certificate | Issue a group housing proof certificate on Balady against the owner's licence |
| Headcount exceeds capacity | Add licensed housing for the extra workers; amending the lease isn't enough |
| The licence has expired | Renew it through the group housing licence renewal service on Balady |
| A breach of the requirements | Fix the item (floor area, bathrooms, facilities) before the next inspection |

The National Program for the Development of Group Housing urges companies to correct their workers' housing through the official routes. Not doing so can mean recorded violations and the suspension of some government services.

## If you get a violation: appeals

| Type of dispute | Where it goes |
|---|---|
| Penalties issued by field inspection committees | **The Board of Grievances (ديوان المظالم)** |
| Building permit disputes | Municipality committees |
| Saudi Building Code violations | The bodies responsible for applying the Code |

Before you appeal, gather the licence number, the lease, the proof certificate, and recent photos that show the housing is compliant.

## FAQ

### What's the fine for unlicensed worker housing?

It depends on the violation, repetition and company size. The bigger impact is that Qiwa services stop, and the CR can be suspended.

### Can Qiwa services really be suspended over housing?

Yes. Establishments that don't hold a group housing licence lose some Qiwa services, such as visa-quota expansion and worker transfers.

### My workers are in licensed housing. Why does Qiwa show a shortfall?

Usually because the company hasn't issued a group housing proof certificate against the owner's licence, or because headcount has grown past the registered capacity.

### Does a housing allowance protect me from a violation?

No. An allowance doesn't exempt the establishment from the group housing licence requirement.

### Where do I appeal a worker housing violation?

Penalties issued by field inspection committees are appealed at the Board of Grievances.
